Terms of Service

1. Who you are contracting with

These Terms govern your use of Diamond Legend (the "Service"). The Service is provided by Terry Pugh, an individual sole proprietor ("we", "us", the "Seller"). By creating an account or using the Service you enter into a binding agreement with the Seller.

2. Acceptance

By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organisation you confirm you have authority to bind it. If you are an individual you confirm you are of legal age in your jurisdiction.

3. The Service

Diamond Legend is a single-player baseball franchise simulation. All league names, player names, and team identities are fictional and generated by the simulation. Diamond Legend is not affiliated with, endorsed by, or sponsored by Major League Baseball, the MLB Players Association, or any professional baseball organisation.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial entertainment.

6. Intellectual property

The Service and all of its content — software, simulation engine, generated player and team identities, artwork, copy, and branding — are owned by the Seller or its licensors and are protected by copyright, trademark, and other intellectual property laws. No rights are granted to you other than the limited licence in Section 4.

7. Account credentials

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately of any unauthorised use.

8. Payments — Stripe as Merchant of Record

Our order process is conducted by Stripe. For eligible transactions Stripe acts as the Merchant of Record, calculates and remits applicable sales tax/VAT/GST, issues receipts, and handles transaction-level support, refunds, and disputes on the Seller's behalf. By purchasing a subscription you also agree to Stripe's checkout terms, which govern payment, billing, tax, cancellation, and refund mechanics. Charges may appear on your bank statement as LINK.COM* alongside the Diamond Legend brand name.

9. Subscriptions and renewals

Pro subscriptions are billed monthly or annually depending on the plan you choose. Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. You can cancel at any time through the customer portal linked from your account; cancellation takes effect at the end of the current paid period. Refunds are handled under our Refund Policy.

10. Suspension and termination

We may suspend or terminate your access to the Service, in whole or in part, without prior notice if: (a) you materially breach these Terms; (b) payment for your subscription fails or is reversed; (c) we reasonably believe your use creates a security, fraud, or legal risk; or (d) we are required to do so by law. You may stop using the Service at any time. On termination, the licence in Section 4 ends; sections that by their nature should survive (IP, liability, governing law) will survive.

11. No warranty

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not guarantee uninterrupted availability or that saved games will be preserved across updates.

12. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the greater of (a) the amounts you paid us in the 12 months preceding the claim or (b) USD 50. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law (such as for fraud, death, or personal injury caused by negligence).

13. Changes to the Service and these Terms

We may modify the Service, prices, or these Terms from time to time. We will give reasonable notice of material changes. Continued use after a change constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the State of the Seller's residence in the United States, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory consumer-protection law in your country of residence requires otherwise.
